Do Bitcoin Sportsbooks Have Licenses?

Is it Legal to Bet on Sports With Crypto?

Crypto sportsbooks operate in a legal grey area. In most of the world there are no specific laws that allow or ban the use of cryptocurrencies for sports betting. Traditional gambling laws were written before the rise of blockchain and digital currencies so most legal frameworks haven’t caught up.

This creates a space where crypto sportsbooks can operate internationally, often licensed in offshore jurisdictions, without being clearly sanctioned or prohibited by local laws. Importantly there are no known cases of individuals being prosecuted for simply using a crypto sportsbook.

Here’s how it looks in some major jurisdictions:

  • United Kingdom: The UK Gambling Commission (UKGC) requires operators to be licensed and compliant with strict regulations. At the moment the UKGC does not issue licenses to crypto only sportsbooks. However players are not breaking the law by using offshore platforms that accept cryptocurrency.
  • Canada: Gambling laws in Canada are provincial. While provinces like Ontario regulate their own markets there is no federal law that bans Canadians from using offshore crypto sportsbooks. Many bettors use international sites without any issues, although these operators are not licensed in Canada.
  • Australia: Domestic operators licensed in Australia are not allowed to accept cryptocurrency as a payment method. However Australians can legally use offshore sportsbooks that accept crypto as current legislation does not criminalize individual players for doing so.

The United States is more complicated. Gambling laws vary from state to state and federal laws add to the complexity. Some states have legalized online sports betting while others have strict prohibitions. The use of cryptocurrency adds another layer of legal ambiguity as it’s not addressed in most state gambling laws. Is Sports Betting Legal in the US?

Since the PASPA Act of 1992 was judicially overturned in 2018, the doors have been flung open to legal online sports betting in the US, with each state able to determine whether or not they wish to permit it.

Currently 38 of the 50 states permit some form of betting, whether through licensed online betting sites or land-based retail outlets, with only 12 not permitting any form of betting whatsoever. However, this number is expected to decrease further in the coming years with several states likely to eventually permit betting, given the size of the tax revenue it can potentially generate.

Additionally, even bettors in states where betting is currently illegal potentially can place wagers thanks to the availability of crypto sportsbooks, such as those listed on this page. We will discuss the legality of these below.

So the simple answer is yes, sports betting is legal in much of the US and, thanks to the abolition of PASPA, every state now retains the right to offer online and retail sportsbooks.

What is PASPA and What Does it Mean for US Bettors?

PASPA, the Professional and Amateur Sports Protection Act of 1992, also known as the Bradley Act, was a law implemented in the United States in 1992 which set out the legal status of sports betting within the country.

Although there were a few exceptions, including Nevada which was allowed to offer sports betting pools at licensed retailers, it effectively made sports betting illegal throughout the country.

It was PASPA which put the US so far behind other major countries, notably the UK, in welcoming sports betting and the eventual onset of online sportsbooks.

However, in 2018 a case, Murphy vs. National Collegiate Athletic Association, was brought to the United States Supreme Court challenging the US government’s right to control state lawmaking and, by proxy, their power to ban sports betting throughout the country.

The court ruled in favor of New Jersey Governor Philip D. Murphy, overturning PASPA and opening the doors to online gambling, including sports betting, throughout the country.

Are Crypto Sportsbooks Legal in the US?

The legality of crypto betting sites in the US is complex and something of a gray area.

The simplest way to summarize the situation is that accessing Bitcoin sportsbooks from the US is not expressly forbidden by law and that nobody has been prosecuted for doing so. The crypto betting sites typically operate legally from overseas jurisdictions and any legal ramifications for welcoming US-based bettors falls on the sportsbooks themselves.

However, it is understandable that some US players may still harbor reservations about joining these sites, given that they don’t hold US licenses, particularly from states that have yet to legalize any form of betting.
